Section 01
Introduction
This Privacy Policy describes how Disaster Pro USA LLC, doing business as Claim Scene Investigation (“Claim Scene Investigation,” “we,” “us,” or “our”), collects, uses, discloses, and protects information about you when you visit claimsceneinvestigation.com (the “Site”), contact us, request a free inspection, or otherwise interact with our services (collectively, the “Services”).
We are a Florida limited liability company with a principal place of business at 1615 S Congress Ave, Suite 103, Delray Beach, FL 33445. We provide water damage restoration, mold remediation, leak detection, and related services exclusively to property owners, managers, and tenants located in the State of Florida.
By accessing the Site or submitting information to us, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with any part of it, please do not use the Site or provide information to us.
Section 02
Information We Collect
Information You Provide Directly
When you submit a form, request a free inspection, schedule service, call us, text us, email us, or otherwise communicate with us, we may collect:
- Identity & contact information: first and last name, mailing address, property address, email address, and telephone number.
- Inquiry details: a description of your water damage, mold, leak, or insurance-claim concern; photos or documents you voluntarily upload or share with our team; preferred appointment times.
- Insurance & claim information: insurance carrier, policy number, claim number, adjuster contact, and related documentation you provide so that we may assist with your claim.
- Communications: the content of calls, voicemails, text messages, emails, chat messages, and any reviews or testimonials you submit.
- Payment information: if applicable, billing details collected and processed by our payment processors. We do not store full payment card numbers on our own servers.
Information Collected Automatically
When you visit the Site, we and our service providers automatically collect certain information using cookies, tracking pixels, server logs, and similar technologies, including:
- Device & browser data: IP address, device type, operating system, browser type and version, screen resolution, and language preference.
- Usage data: pages visited, time spent on pages, referring URL, clicks, scroll depth, the search terms you used to find us, and how you navigate the Site.
- Approximate location: coarse geolocation derived from your IP address (typically city or region level — not precise GPS coordinates).
- Call tracking data: if you call a tracked phone number on our Site, we may collect the calling number, call duration, time and date, and a recording of the call where permitted by law and disclosed to you at the start of the call.
Information From Third Parties
We may receive information about you from third parties in connection with our Services, including:
- Insurance carriers, adjusters, and partners who refer you to us or with whom you have authorized us to coordinate on your behalf.
- Advertising and analytics platforms (such as Meta and Google) that share aggregated or hashed data about ad performance.
- Public sources, such as property records, when relevant to scoping or investigating a loss.
Section 03
How We Use Your Information
We use the information we collect to:
- Provide, schedule, and perform the Services you request, including inspections, restoration, remediation, and leak detection;
- Communicate with you about appointments, status updates, estimates, invoices, and follow-up — by phone, text message, email, or mail;
- Coordinate with your insurance carrier or adjuster, when authorized, on documentation, scope of work, and claim payment;
- Send you marketing communications about our services, seasonal reminders, promotions, and educational content (you can opt out at any time — see Section 4);
- Operate, maintain, secure, troubleshoot, and improve the Site and Services;
- Measure the effectiveness of our advertising and tailor ads you may see on third-party platforms;
- Detect, investigate, and prevent fraudulent, unauthorized, or illegal activity, and protect the rights and safety of our company, our customers, and the public;
- Comply with applicable law, court orders, subpoenas, and lawful requests from government authorities; and
- Establish, exercise, or defend legal claims.
Section 04
Calls, Text Messages & Email Communications
This section describes how we communicate with you and the choices you have. By providing your phone number or email address to us — for example, by submitting a contact form, requesting a free inspection, or opting in to text messages — you are giving us your prior express consent to be contacted at that phone number or email address as described below, including by automated dialing systems and pre-recorded messages where applicable.
Phone Calls
We use phone calls to follow up on inquiries you submit, confirm or reschedule appointments, provide service updates, coordinate with you and your insurance carrier, and answer your questions. We do not place cold sales calls and we do not call numbers on do-not-call lists for marketing purposes unless you have given us your prior express written consent. Calls may be monitored or recorded for quality assurance, training, and compliance, where permitted by law and disclosed to you at the start of the call.
Text Messages (SMS / MMS)
We use SMS and MMS messaging — delivered through our service provider, GoHighLevel — to send appointment confirmations, reminders, status updates, dispatch notifications, and, with your consent, marketing and promotional messages.
- Consent: Messages will only be sent to phone numbers for which we have your prior express consent, given through our web forms, in writing, or verbally. Consent is not a condition of purchasing any goods or services.
- Message frequency: Up to six (6) messages per month, depending on your activity with us.
- Message and data rates: Standard message and data rates from your wireless carrier may apply. We are not responsible for those charges.
- Opt out — STOP: You can cancel SMS messages at any time by replying STOP to any message we send. After you reply STOP, we will send a confirmation that you have been unsubscribed and you will not receive additional messages, except where transactional messages are necessary to complete a service you have requested.
- Help — HELP: Reply HELP at any time to receive information about the messaging program and how to contact us.
- Carrier disclaimer: Mobile carriers are not liable for delayed or undelivered messages.
- Eligible carriers: Supported on all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, and others. Service may not be available on all carriers at all times.
The phone numbers and consent you provide for text messaging are not shared with third parties or affiliates for their marketing purposes. Mobile opt-in data and consent records are kept confidential within our company and our SMS service provider.
We use email to respond to inquiries, send transactional messages (such as inspection confirmations, estimates, invoices, and service updates), and — when you have not unsubscribed — to send marketing messages. Marketing emails are delivered via our email service providers, including Resend and GoHighLevel, with workflow automation through n8n. Every marketing email contains an unsubscribe link, and you can also opt out at any time by emailing office@claimsceneinvestigation.com.
Even After You Opt Out
Even if you opt out of marketing communications, we may still contact you with transactional or service-related messages — for example, to respond to a request you submitted, confirm an appointment, deliver an invoice, or address a safety or warranty issue.
Section 07
Insurance Partner Sharing
Because much of our work involves coordinating with property insurance carriers, we may share relevant information about your loss and your property with:
- Your insurance carrier, adjuster, and any independent or public adjuster you have engaged;
- Licensed Florida insurance professionals working with us on your claim;
- Select restoration, remediation, plumbing, or specialty partners engaged to perform a portion of the scope of work; and
- Legal counsel representing you or us in connection with the loss or claim.
We share only the information necessary for these parties to perform their role. By engaging us in connection with an insurance claim, you authorize us to communicate and share documentation with the parties above as reasonably necessary to investigate, document, scope, perform, and obtain payment for the work.
Section 08
Data Retention
We retain personal information for as long as we need it to provide our Services, comply with our legal and contractual obligations, resolve disputes, and enforce our agreements. In general:
- Active customer records: retained for the duration of the engagement and for the period required by Florida construction, insurance, tax, and recordkeeping laws — typically up to seven (7) years after the close of a job or claim.
- Lead and inquiry records (no service provided): retained for up to seven (7) years from the date of the inquiry to assist with re-engagement, follow-up, and recordkeeping.
- SMS and email opt-in / opt-out records: retained for as long as the consent is active and for a reasonable period after revocation, to demonstrate compliance with applicable communications laws.
- Site analytics & advertising data: retained according to the retention defaults of the underlying tools (for example, Google Analytics 4 retains user-level data for up to 14 months by default).
When we no longer need information, we delete or de-identify it in a secure manner.
Section 09
Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. These safeguards include encrypted connections (HTTPS), access controls, vendor due diligence, and limiting access to personnel who need it to perform their job.
No method of transmission over the internet or electronic storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for maintaining the secrecy of any account credentials and for the security of devices used to access the Site.
Section 10
Your Privacy Rights (Florida)
Claim Scene Investigation is a Florida business that serves customers located in Florida. Regardless of whether the Florida Digital Bill of Rights (Fla. Stat. § 501.701 et seq.) applies to us based on its business-size thresholds, we voluntarily extend the following rights to all Florida visitors and customers:
- Right to know & access: You can request confirmation of whether we are processing personal information about you and a copy of the information we hold.
- Right to correct: You can request that we correct inaccurate personal information.
- Right to delete: You can request that we delete personal information about you, subject to exceptions for records we are required or permitted to keep by law (for example, completed jobs, insurance documentation, accounting records, and SMS opt-out logs).
- Right to data portability: You can request a copy of certain personal information in a portable, machine-readable format where technically feasible.
- Right to opt out of targeted advertising: You can ask us to stop using or sharing your personal information for cross-context behavioral or targeted advertising. You can exercise this right at any time using our cookie banner or by contacting us.
- Right to opt out of the “sale” or “sharing” of personal information: We do not sell personal information for money. We do, however, use advertising cookies and pixels (Google Ads, Meta Pixel, and similar) that some laws may treat as “sharing.” You can opt out of these by rejecting marketing cookies in our cookie banner.
- Right against profiling that produces legal or similarly significant effects: We do not use automated profiling to make legal or similarly significant decisions about you.
To exercise any of these rights, email office@claimsceneinvestigation.com with the subject line “Privacy Request” and describe the right you wish to exercise. We may need to verify your identity before fulfilling your request — for example, by confirming information already on file with us. We will respond within the timeframe required by applicable law (and within forty-five (45) days where no specific timeframe applies). If we deny your request, we will explain why and, where required, you may appeal that decision by replying to our response.
We will not discriminate against you for exercising any of these rights.
Section 11
Children's Privacy
Our Services are intended for adults aged 18 and older. We do not knowingly collect personal information from children under the age of 13. If you believe a child under 13 has provided us with personal information, please contact us at office@claimsceneinvestigation.com and we will take reasonable steps to delete that information.
Section 12
Third-Party Links
The Site may contain links to third-party websites, including review platforms, social media, payment processors, and partner sites. We are not responsible for the privacy practices or content of those sites. We encourage you to read their privacy policies before providing them with information.
Section 13
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of the page. If we make material changes, we will provide additional notice — for example, by posting a prominent notice on the Site or, where appropriate, sending an email to the address we have on file. Your continued use of the Site after the effective date of an updated Privacy Policy constitutes your acceptance of it.
